Charged early termination fee with no proof of contract

I purchased a new phone in October of 2012 to replace one my son smashed.  I went with the equipment installment payment plan for the full price of the phone because the TMobile representative at the local store informed me there would be no early termination fee associated with my account if I did it that way.  I switched my wife's phone to another carrier that provides data service in my area this past for a Christmas gift.  I was shocked to see today that I am being charged with an early termination fee for porting her line to another provider.  I spoke with a customer service representative on the phone today who told me that my contract for both lines does not expire until October of 2014.  She could not speak for the person who sold me the phone at the local store in 2012. She told me I needed to go to the local store and ask to view the contract to verify that there should have been no early termination fee applicable as there was no contract, as I was already month to month in October of 2012.  I went to the local store today and was informed that they do not keep the hard copy contracts after approximately 30-60 days,a s they are sent to an archive company out of State.  So my situation is now I can't prove that there was no service extension to my account, and TMobile can't prove that I did.  How do I get this issue resolved?  I have been a TMobile customer for years, and have never had any issues until now.  This is a pretty big issue for me.  I am waiting to speak to the manager of the local store when he comes in tomorrow to see what help he can provide.  Until then I am trying to get any help anywhere I can find it.
